Under Florida law, there are a few basic rules for determining who owns the property of a recently deceased loved one. If the property was owned jointly by spouses or by "joint tenants with rights of survivorship" between two non-married individuals, then that property belongs to the surving spouse or tenant. If the property was in the name of the deceased alone, then it will be distributed under the terms of the deceased's will. If there is no will, the property will be distributed under the law as defined by Florida Statutes.
